Abstract
This Decree issues the Decision of the Standing Committee of the National People's Congress to Amend Fifteen Laws Including the Law of the People's Republic of China on the Protection of Wild Animals.
The Laws amended by the Decree include: the Law of the People's Republic of China on the Protection of Wild Animals, the Metrology Law of the People's Republic of China, the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, the Law of the People's Republic of China on the Protection of Disabled Persons, the Law of the People's Republic of China on the Protection of Rights and Interests of Women, the Advertising Law of the People's Republic of China, the Law of the People's Republic of China on Energy Conservation, the Law of the People's Republic of China on Desert Prevention and Transformation, the Law of the People's Republic of China on Promotion of Agricultural Mechanization, the Law of the People's Republic of China on Agricultural Product Quality Safety, the Circular Economy Promotion Law of the People's Republic of China, the Environmental Protection Tax Law of the People's Republic of China, etc.
The Law of the People's Republic of China on the Protection of Wild Animals is amended into: (1) In Article 7, “forestry” is replaced with “forestry and grassland”. (2) In paragraph 2 of Article 35, “Entry and exit quarantine shall be carried out in accordance with the law. The Customs shall handle the customs clearance formalities on the basis of the certificate allowing import and export and the quarantine certificate in accordance with the relevant provisions” is replaced with “The Customs shall carry out entry and exit quarantine in accordance with the law, and handle the customs clearance formalities on the basis of the certificate allowing import and export and the quarantine certificate in accordance with the relevant provisions”.
Amendments to the Circular Economy Promotion Law of the People's Republic of China include: (1) Amend "relevant competent authorities for environmental protection" in Article 5, Article 12, Article 14, Article 17, Article 18, Article 19, and Article 28 to "competent ecological environment authorities and other relevant authorities". (2) Amend the "competent forestry authorities Administration" in Article 35 to "competent forestry and grassland authorities".
