Abstract
As the first food safety regulation of Hubei Province, this Regulation is formulated to ensure food safety and protect the health and life safety of the public. The Regulations is based on the guidance of the Food Safety Law of the People's Republic of China, and is tailored to the province's specific circumstances.
The Regulation consists of eighty-six articles divided into six chapters: General provisions; Food production and business operation; Food safety assurance; Information disclosure and social participation; Legal liabilities; and supplementary provisions. The Regulation requires food producers and business operators to bear the main responsibilities for food safety, accept social supervision, and assume social responsibilities. The food safety committee of the local people's government at or above the county level are tasked with:(1) Research and deploy, coordinate and guide food safety work within the administrative region;(2) Develop major policy measures for food safety supervision and management;(3) Research, coordinate, and decide on the responsibilities of food safety supervision and management;(4) Supervise the implementation, assessment and evaluation of food safety supervision and management responsibilities;(5) Organize and coordinate emergency response and investigation of food safety accidents;(6) Establish and improve coordination, linkage, comprehensive supervision and management, and information sharing mechanisms; etc.
The Regulation establishes a permit management system for small workshops and small catering services, and a registration management system for food vendors. The Regulation further stipulates that food business operators on the network must obtain a license in accordance with the law and publicly display information such as food production and operation licenses in a prominent position on their websites; Third party platform providers for online food trading should establish management systems for the review and registration of food producers and business operators, the review of food sales information, food safety inspections, handling of illegal activities, and handling of complaints and reports. In addition, those engaged in the business operation of health food shall obtain corresponding licenses in accordance with the law and sell them in the licensed business premises; Health food products shall not be promoted with exaggerated functions, false or misleading information, and shall not be sold on site outside of licensed business premises.
The centralized sales market for edible agricultural products should establish and improve the management system related to the safety of edible agricultural products, including a market access system for edible agricultural products. Sellers of edible agricultural products should establish a system for inspecting and recording the purchase of edible agricultural products. The Regulation also highlights the special supervision on food provided for schools, public participation in food safety governance, offence and panalties.
