Abstract
This Regulation is formulated to ensure food safety and protect the health and life safety of the public. The Regulation is based on the Food Safety Law and the Agricultural Product Quality and Safety Law of China and is tailored to the province's specific circumstances. It governs the production, business operation and safety management of food, food additives and food-related products, the use of food additives and food-related products, and the storage and transportation of food.
The Regulation, consisting of 6 Chapters and 80 Articles, make provisions on food production and operation, food safety assurance, supervision and administration, legal liability and other aspects.
In particular, the Regulations focuses on regulating online food producers, business operators, third-party platforms, and delivery based on the actual situation in Jiangsu. For food producers and business operators who enter the network, the Regulation specifies that they should obtain a food production and operation license or make filing in the systems; Sales records should be established and relevant vouchers and records should be kept within a certain period of time for traceability management. The Regulation also encourage online catering service providers to publicly display their processing and production sites in real-time through video, marking the time of food processing and production and the time limit for consumption, and accepting social supervision. For third-party platforms for online food trading, the Regulation distinguishes between registration in Jiangsu and registration outside the province, clarify filing and reporting requirements, and require them to establish and improve a food safety evaluation system for food producers and business operators who enter the network. They are not allowed to provide services to food producers and business operators without licensing qualifications. Selling food on social media platforms and live streaming platforms has also been included in the regulatory scope. The Regulation also provides for the training and management of delivery personnel, prevention of contamination during storage and delivery, and measures for preservation and insulation in online food trading and distribution.
