Measures for the Energy Conservation Examination of Fixed-Asset Investment Projects (2023).

These Measures are formulated in accordance with the Energy Conservation Law, the Administrative Licensing Law, the Regulations on Energy Conservation of Civil Buildings, and the Regulations on Energy Conservation of Public Institutions, aiming to improve the adjustment and control of the total amount and intensity of energy consumption, promote the scientific and rational use of energy in fixed asset investment projects, strengthen energy management, promote energy conservation, prevent energy waste, improve energy utilization efficiency, and promote the realization of carbon peak and carbon neutrality. The Text consists of 33 Articles divided into 6 Chapters.
The term "energy conservation examination" as mentioned in these Measures refers to the the act of reviewing the energy consumption, energy efficiency level, and energy-saving measures of a project in accordance with energy-saving laws, regulations, policies, standards, etc., and forming review opinions. Energy saving examinationof fixed assets investment projects is an important basis for project construction, completion acceptance and operation management. For government investment projects, the construction entities should obtain the energy conservation examination opinions issued by the energy conservation review agencies before submitting the feasibility study reports. For enterprise investment projects, the construction unit needs to obtain the energy-saving examination opinions issued by the energy-saving examination agencies before starting construction. Projects that have not undergone energy-saving examination in accordance with the provisions of these Measures or have not passed the energy-saving examination shall not be started by the construction unit, and those that have already been completed shall not be put into production or use.
