Abstract
For the purposes of implementing the Regulations of the People's Republic of China on Administration of Environmental Protection in Exploration and Development of Offshore Petroleum, these Measures are formulated in accordance with Article 47 of the Marine Environmental Protection Law of the People's Republic of China. These Measures are applicable to any legal and natural persons and other economic entities engaged in the exploration and development of petroleum in inner sea, territorial sea and other waters under the jurisdiction of the People's Republic of China. The Measures consist of 35 articles.
Any offshore petroleum developer shall prepare marine environmental impact statement in accordance with content provisions specified in Article 5 of the Regulations meanwhile with preparing the overall programs for developing petroleum (gas). Entities engaged in assessment of environmental impact must be capable of doing assessment of marine environmental impact and hold Level A environmental impact assessment certificates. When it is necessary to utilize explosive sources and other measures which threaten to damage fishery resources for seismic prospecting operation of offshore petroleum, a plan and operation sea areas shall be reported to the competent authority for the sea area a half month before commencing the operation and effective technological measures shall be adopted to reduce damage to or impact on resources to the utmost extent. In order to prevent and control oil spill pollution and reduce damage from pollution, an operator engaged in the exploration and development of offshore petroleum shall draft oil spill emergency plans according to the requirements provided in article 10. Other provisions of these Measures deal with the emergency response and reporting, records and book keeping, compensation for oil pollution damage and offences and penalties.
