Abstract
These Measures are enacted in accordance with the Law of the People's Republic of China on Administrative Penalty, aiming at regulating the exercise of the discretion in administrative penalty, ensuring the legitimacy and rationality of administrative penalty, and protecting the lawful rights and interests of citizens, legal persons and other organizations.
The national maritime administrative body shall uniformly take charge of the implementation and administration of the discretion in maritime administrative penalty across the country. In respect of cases with the same or similar nature, circumstances, degree of social danger, etc. of illegal maritime acts, the applicable legal basis and the categories and extent of penalties shall be the same or similar in the imposition of administrative penalties. The higher-level maritime administrative body shall supervise and inspect the exercise of the administrative penalty discretion of the lower-level maritime administrative body.
