Abstract
These Measures are formulated in accordance with the Regulations of the People's Republic of China on Wild Plants Protection, aiming to protect and rationally utilize the rare and endangered wild plant resources, protect biodiversity and strengthen the management of wild plants. The Regulations consist of the following Chapters: General Provisions (I); Protection of Wild Plants (II); Administration of Wild Plants (III); Legal Responsibilities (IV); Supplementary Provisions (V).
The Ministry of Agriculture shall be in charge of the supervision and administration of wild plants in the country, and set up the National Wildlife Supervision and Administration Office for the daily work thereof.
Lists of wild plants under special state protection shall be drawn up by the Ministry of Agriculture, examined by the expert committee of wild plants protection, and approved by the State Council. The national or provincial nature reserves of wild plants under special state protection shall be delineated and established by the Ministry of Agriculture and the provincial agricultural authorities. The national key protected wild plant monitoring system shall be established for dynamic monitoring.
The collecting of wild plants under first class state protection shall be prohibited, unless it is necessary to carry out a small amount of collection for some special purposes such as scientific research or cultivation, and a permit for collection shall be obtained. For the export of wild plants under special state protection and the import or export of wild plants whose import or export is restricted by international conventions to which China is a party, the application must be verified by the local provincial agriculture competent authority, and then be submitted to the Ministry of Agriculture for approval, and an import or export permit must be obtained.
