Abstract
These measures are formulated in accordance with the relevant provisions of such laws and regulations as the Urban Real Estate Administration Law of the People's Republic of China, Provisional Regulations of the People's Republic of China on the Assignment and Transfer of the Right to Use the State-Owned Land of Cities and Townships, and Measures of Shanghai Municipality for Implementing the Land Administration Law of the People's Republic of China for the purpose of perfecting the system on the paid use of land of this municipality and standardizing the assignment of land use rights.
The Measures consist of 5 Chapters: General provisions; Scope, methods, and procedures for transferring land use rights; Recovery of land use rights transferred; Legal liabilities; Supplementary provisions.
The transfer of land use rights shall be subject to the signing of a transfer contract. The transfer of land use rights must be carried out in accordance with the requirements of the overall land use plan, urban planning, annual land use plan, and urban planning management technology regulations of this city. The transfer fee and land use fee shall be fully paid to the finance department in accordance with regulations, included in the budget, and specifically used for urban infrastructure construction and land development.
