Abstract
The Rules regulate pollutant-discharge rights trading in the Ningxia Hui Autonomous Region to improve environmental-resource allocation, ensure orderly transfers and protect the parties’ lawful interests. Transactions must generally occur through the regional public-resource trading platform and follow voluntary, honest, open, fair and impartial procedures.
The Rules define eligible sellers and buyers, tradable rights and disqualifying circumstances. They establish public bidding, negotiated transfers and simplified transfers for small-emission projects, together with application review, disclosure, contracting, payment and registration procedures. Cross-city purchases require specified approvals, and transactions may be terminated for ownership disputes, market manipulation or procedural obstacles. Acquired rights are a prerequisite for relevant pollutant-discharge permits. Fraud, collusion, non-payment and other violations may invalidate results and incur civil, administrative or criminal liability.
