Abstract
This bilateral Protocol establishes binding inspection, sanitary, and phytosanitary requirements for the export of wheat flour from Ukraine to China, in line with WTO SPS Agreement principles. The Protocol defines wheat flour, confirms its Ukrainian origin, and obliges Ukraine to ensure that exported flour complies fully with Chinese food safety, plant quarantine legislation, and national standards, including the absence of Tilletia controversa and other regulated contaminants.
The Protocol sets out detailed responsibilities for the Ukrainian authority, including supervision of wheat cultivation, flour production, storage, transportation, and export procedures. It requires regular monitoring and risk analysis, annual surveys for Tilletia controversa, registration and inspection of production and processing enterprises, and strict controls over packaging, labelling, and traceability. Prior to export, transport vehicles must be inspected, contaminated consignments must be blocked, and only compliant wheat flour may be shipped. Each export consignment must be accompanied by a phytosanitary certificate and an additional food safety certificate, explicitly confirming compliance with the Protocol and freedom from quarantine pests.
On arrival in China, customs authorities conduct quarantine and food safety inspections and may apply corrective measures, including treatment, return, or destruction of non-compliant consignments. Repeated violations may lead to suspension of imports from specific enterprises or facilities, and China reserves the right to revise its risk assessment or conduct on-site inspections in Ukraine. The Protocol provides for cooperation, information exchange, dispute resolution through consultations, and amendments by mutual consent.

Entry into force notes
This Protocol enters into force on the date of its signing and shall remain in force for a period of five years. Thereafter, this Protocol shall be automatically extended for successive five-year periods unless one of the parties, the State Food and Consumer Protection Service or the General Administration of Customs of the People’s Republic of China, notifies the other party in writing of its intention to terminate this Protocol. This Protocol shall terminate six (6) months after the other Party has received written notice to that effect.
