Regulation of Hainan province on environmental protection.

This Regulation aims to protect and improve the environment, prevent and control pollution and other public hazards, enhance the construction of ecological civilization and promote sustainable economic and social development of Hainan province. The Regulation consists of 6 Chapters divided into 69 articles: General Provisions (I); Environment supervision and administration (II); Environment protection and improvement (III); Prevention and control of pollution and other public hazards (IV); Legal liability (V); Supplementary provisions (VI).
The Regulation provides for the obligations and responsibilities of the governments, entities and individuals on environment protection. It conducts comprehensive specifications on prevention and control of industrial and domestic pollution in terms of atmosphere, water, solid waste, noise, and electromagnetic radiation. The total amount control of the main pollutants shall be put into practice in Hainan province. The province may develop pollutant discharge standards which are stricter than the national discharge standards. The Regulation stipulates the institutional arrangements and promotion of the construction of a national demonstration area of ecological civilization, including the transformation of the mode of economic development. The remaining articles of this Regulation make provision, inter alia, for environmental planning; environmental impact assessment of special planning and projects; protection and management of ecological core areas; delineation of important ecological function protection zones; establishment of natural reserves; ecological protection compensations; pollutant discharge permit; pollutant discharge fee; supervision and inspection; and offences and penalties.
