Abstract
These Regulations are formulated in accordance with the Forest Law and the Regulations on Urban Greening of the State Council, aiming to protect ancient and famous trees. The Regulations consist of 6 Chapters: General provisions; Identification of ancient and famous trees; Maintenance of ancient and famous trees; Management of ancient and famous trees; Supplementary provisions.
Ancient trees are classified as: (1) Ancient trees with a age of more than 1,000 years are subject to special protection; (2) Ancient trees with a tree age of more than 500 years and less than one thousand years shall be protected at the first level; (3) Second-level protection shall be applied to ancient trees with a tree age of more than 300 years and less than 500 years; (4) Three-level protection shall be applied to ancient trees with a tree age of more than 100 years and less than 300 years. Famous trees are subject to first-level protection.
Governments at all levels shall organize and coordinate the protection and management of ancient and famous trees in a unified way, include the funds required for the protection of ancient and famous trees in the budget, and bear the daily maintenance costs of ancient and famous trees. No unit or individual is allowed to move or damage the protection boards and facilities of ancient and famous trees without authorization. When transplanting ancient and famous trees, transplanting shall be carried out in accordance with the approved transplanting plan and the transplanting site. No unit or individual may, without authorization, dispose of ancient and famous trees that have not been confirmed dead by the competent department of ancient and famous trees and whose files have been cancelled.
