Abstract
These Regulations are formulated in order to ensure the quality of products, facilitate international trade and promote international cooperation in quality certification. The product quality certification shall be carried out by a certification body, on the basis of the compliance of the product with the relevant standards and technical requirements.
The certification body shall issue a certificate and a certification mark. Article 4 draws a distinction between (a) safety certification and (b) conformity certification. Products under safety certification must conform to the requirements of the relevant compulsory standards stipulated in the Standardization Law; products under conformity certification must comply with the requirements of the national or sector standards provided for by the Standardization Law. The competent department of the standardization administration under the State Council shall be in charge of the unified administration of certification throughout the country, and shall exercise, among other matters, the following functions: (a) formulation of the principles and policies; (b) approval of the certification testing bodies, and of the catalogues of products to be covered by certification; (c) administration of certification inspectors; (d) supervision of the certification work. The competent departments at local level shall exercise their duties within their administrative areas.
The Rules provide for the establishment of a certification committee, composed of experts from the relevant departments of production, marketing, utilization, scientific research and quality supervision of products. Further provisions concern the qualifications and procedures to be followed to apply for certification, the administration and duties of testing bodies and inspectors, and offences and penalties.
These Regulations do not apply to military products.
