Abstract
The purpose of the regulations is to strengthen port management, protect and rationally develop and utilize port resources, maintain the security and order of the port business, and protect the legitimate rights and interests of relevant parties. The Regulations consist of 47 articles divided into 6 Chapters: General provisions (I); Port planning (II); Use of port coastline and port construction (III); Port business operations (IV); Port Safety and Supervision (V); Legal Responsibility (VI); Supplementary Provisions (VII). Port planning include the provincial port layout planning, port overall planning and detailed planning for controlling harbor areas. Port construction projects shall be subject to examination, review and approval in accordance with national and provincial regulations. Port construction project environmental impact assessment shall be carried out according to the law, and safety evaluation shall be made for dangerous cargo port projects or passenger terminal construction projects. Whoever intends to engage in the business operation of a port shall apply to the administrative department of port for obtaining the permit and shall make industrial and commercial registration in accordance with the law.
