These Special Administrative Measures (Negative List) for the Access of Foreign Investment (2018) consisting of 48 articles, down from originally 63 articles, expands market access in finance, transportation, commerce & trade, professional services, manufacturing, infrastructure, energy, resources and agriculture.
The negative list shows the areas and industries that foreign investors cannot invest in. Foreign investors are not allowed to invest in the areas prohibited from foreign investment in the Negative List.
Foreign investors are forbidden to engage in investment activities as individual businesses, investors of sole proprietorship enterprises, or members of farmers' professional cooperatives. For agriculture, investment in the research and development and breeding and planting of China's rare and unique precious quality varieties as well as the production of relevant breeding materials (including quality genes of planting, animal husbandry, and aquaculture) is banned. Investment in the selection of genetically modified varieties and the production of genetically modified seeds (fingerlings) in respect of crops, breeding stock, and poultry as well as aquatic fingerlings is prohibited. Rice and soybean belong to the foreign investment forbidding fields.
