Decree-Law No. 47/2021 approving the general bases for the concession of the management, exploration and distribution of water resources for irrigation.

This Decree-Law, under Legislative Decree No. 3/2015 of 19 October, approves the general bases for the concession of the management, exploration and distribution of water resources for irrigation. The purpose of the concession is the service of management, exploration and distribution of water resources for irrigation dealt with the institution gua de Rega (AdR), Sociedade Unipessoal, SA. The concession lasts for ten years. The grantor has the right to unilaterally suspend the concession period in the event of a state of war, state of siege or emergency, not having any right for compensation. For the period in which the suspension takes place, the obligations of the concessionaire designated in the concession contract are also suspended. The concession to AdR comprises the management, exploration and distribution of water for irrigation defined in the concession. The concession to AdR covers the entire national territory under the terms of the concession contract. The concession for the management and exploitation of the public service is formalized through a concession contract granted between AdR, as a concessionaire, and the State of Cape Verde, directly and jointly, as a granting entity.
