Abstract
This Order approves the Statute of the Official Industrial Property Agent with the primary objective of strengthening the national system for the protection of industrial property rights. It establishes a clear legal framework governing access to, recognition of, and exercise of the profession of official industrial property agent, in response to the growing complexity and demand for specialized services following the adoption of the new Industrial Property Code. The Order seeks to ensure that representation and technical assistance before the national industrial property authority are carried out by professionals who meet defined standards of qualification, competence, and probity, thereby safeguarding the correct application of industrial property law and the rights of title holders. In addition, it aims to enhance quality, transparency, and trust in the industrial property system by regulating professional requirements, examinations, ethical conduct, and procedural rules applicable to official agents. Through provisions on training, examination, professional responsibilities, supervision, and sanctions, the Statute promotes continuous specialization and ethical practice, aligns Cabo Verde with international best practices in industrial property representation, and contributes to effective protection of intellectual assets, legal certainty for users, and the overall development of the economic, technological, and innovation environment in the country.
