Abstract
This Agreement aimed to regulate navigation, usage, and upkeep of shared border waters, including rivers like the Oder and Nysa Łużycka. It established guidelines for cooperation in managing these waterways, ensuring their proper maintenance and utilization for mutual benefit. The Agreement grants both Poland and Germany equal rights to navigate and float on frontier waters. The Agreement further outline agreement of the two parties on navigation rules, mooring and emergency landing, assistance in shipwrecks, waterway maintenance and liability for damages and compensation. To ensure safe navigation and floating on frontier waters, both parties share responsibility for detecting, marking, and removing obstructions while maintaining proper depths through dredging as designated by the Mixed Commission. Each party will maintain and update navigation plans, promptly informing the other of any changes to navigation marks. Additionally, both parties commit to maintaining proper water conditions by preventing alterations that could disrupt natural water flow, avoiding actions that lower water levels necessary for navigation, regularly cleaning watercourses, and implementing measures to control water entering the frontier sections of the Oder and Nysa Łużycka rivers.
The Agreement consists of 33 Articles divided into 5 Chapters. Chapter III refers to principles of co-operation in precautionary measures against flooding and ice-floes and Chapter IV address use of frontier waters. The text includes final protocol and additional protocoal both attached to the main Agreement concerning navigation in frontier waters and the use and maintenance of frontier waters.
