Abstract
This law aims to regulate and protect against various forms of environmental pollution and emissions in the state of Berlin. It is structured into different parts, each addressing specific aspects of environmental protection. The first part of the law outlines general provisions and definitions related to immission control obligations. The second part focuses on noise protection measures, including regulations for nighttime, Sunday, and holiday rest periods, as well as guidelines for sound reproduction devices, musical instruments, fireworks, machinery, and outdoor events. The third part deals with protection against other forms of immissions and specific emission sources. It covers issues such as dust, animals, and the operation of engines, devices, and machines. The law empowers authorities to request additional documentation to ensure compliance with regulations and may impose measures to safeguard against noise immissions if necessary. Furthermore, the law provides guidelines for the application and notification procedures for general administrative acts related to immission control. It also addresses the assessment of noise immissions and sets out provisions for enforcement, legal regulations, monitoring, penalties for violations, data processing, and cost allocation. The law contains 23 Articles.
