Abstract
The Law encompasses various provisions and objectives aimed at making a significant contribution to climate protection and coping with the inevitable consequences of climate change. The Law provides a hierarchy for climate protection ranging as: (1) avoiding greenhouse gas emissions, (2) reducing greenhouse gas emissions, and (3) sequestering greenhouse gases that cannot be avoided or reduced with reasonable effort. The law emphasizes the preservation, protection, and establishment of natural carbon sinks to contribute to climate protection and resilience. In chapter 2 the Law sets sectoral targets and goals for state administration, and objectives for municipal administrations for climate protection. Public authorities are tasked with a general role model function in climate action, prioritizing measures according to the climate hierarchy within their organizational scope and there exists an obligation to consider climate aspects in planning and decision-making processes. It also establishes funding programs to support measures for climate protection and adaptation. In Chapter 4 the text provides for conservation of energy, promotion of renewable energies through ensuring availability of land, and installation of photovoltaic systems and distribution networks. Final Chapter provides for the administration process, monitoring and financial compensation.
Article 23 of the text provides for the obligation to install photovoltaic systems for electricity generation on new constructions and significant roof renovations on suitable roof areas, as well as to new construction of open parking lots with more than 35 spaces. The Ministry of the Environment coordinates cross-sectoral tasks under this law, overseeing the Climate Action Register, developing strategies for adapting to unavoidable climate change effects, and implementing concepts for achieving net greenhouse gas neutrality in the state administration. The Ministry of the Environment, in agreement with the relevant ministries, evaluates the implementation status of § 23 by December 31, 2025, focusing on the extent to which the expansion of photovoltaics is being promoted.The text consists of 35 Articles divided into 5 Chapters and has 2 Annexes as follow: General provision (1); Climate protection goals (2); Measures and monitoring (3); Energy, heat, and transport transition (4); and Supplementary provisions (5).
