Abstract
The present Ordinance implements various articles of the Hamburg Water Law of 20 June 1960 (HmbGVBl. p. 335). The Ordinance is applicable to public flooding protection facilities including parts lying outside the area. Article 3 establishes that such facilities shall be constructed, run and maintained in such a way that they shall at any time ward off flooding and high tide. The text – consisting of 15 articles – deals with the following aspects: sphere of application, definition of terms, survey of site, establishment of protection zones, maintenance of dikes, prohibitions and limitations, authorization for erecting dikes, surveillance of flooding protection facilities, land in front of dikes, penalties and transitional provisions.
