Abstract
The objective of this Law is to give special attention to water, nature, and animal protection as long as concerned fishing and angling as significant activities in Hamburg's waters. The Law aims to protect waters and its ecosystem as the habitat of the fish and the plants. The Law governs fishing activities in both inland (Elbe) and coastal waters, as well as the legal interactions involving fishing vessels bearing Hamburg fishing license plates. The text further provides for the fishing license and permit access to the banks and waters. Section 2 of the text provides for requirements for fishing license, fishing test, and fishing tax and levies. The Law provides some prohibition on fishing methods including prohibiting use of artificial light, explosives, anesthetics, toxic substances, traps, and harmful devices. The text further lays out for fisheries supervision and management, authorizations and data protection and administrative offences. The Act aims to support conservation of fish stocks, by taking into account biodiversity and water protection, by means of modern conservation instruments. The Act further lays out for ensuring the sustainable use and conservation of the fish resources and their habitats in Hamburg. It also seeks to promote the interests of the fishers and anglers with special attention to water, nature and animal welfare issues.
The Act consists of 25 Articles divided into eight sections, each containing several subsections that define the terms, scope, content, and exercise of the fishery rights, as well as the fishery license, examination, fee, supervision, and protection. The text also specifies the prohibitions, permissions, and obligations for different types of fishing, such as angling, electrofishing, and professional fishing. It also lists the possible offenses and penalties for violating the law.
