Abstract
This Law lays down conditions to ensure the economically stable transfer of farms to the next generation. By creating a balanced agricultural structure and strengthening local farmers, the Law is intended to help support agriculture in the state of Brandenburg. A central concept in this law is the farm, which is defined as an agricultural or forestry property. A farm must have a farmstead suitable for its cultivation and be either the sole property of a natural person, the joint property of spouses (spousal farm) or part of the joint property of a continuing community of property. The Law aims to protect agricultural land from being sold off for non-agricultural purposes, ensuring that it remains available for farming activities. Furthermore, the Law specifies the rights and responsibilities of farm owners, including their obligations to maintain the productivity and sustainability of the farm. The Law also regulates procedures such as the entry and deletion of farm notes in the land register, the adjustment procedure for rights based on previous inheritance law provisions. The Law consists of 34 Articles.
