Abstract
The document primary focus is the establishment of water maintenance associations as public law corporations responsible for the maintenance and management of water bodies. The law aims to ensure effective water management in accordance with the Thüringer Water Law (ThürWG) and establishes a framework for the governance and operational structure of these associations, emphasizing the importance of regional water management in the context of environmental protection and public welfare. The document specifies several key measures, including the establishment of member municipalities within defined association areas based on watershed boundaries. It mandates the creation of a directory of water bodies under the maintenance responsibility of the associations and requires that any changes to the association's statutes be approved by the legal supervisory authority. The law also outlines the responsibilities of the association assembly in approving maintenance plans and allows for the delegation of tasks to other water management entities, contingent upon the approval of the supervisory authority. The law contains 6 Articles referring to legal provisions, the authority to enact statutes, the structure and responsibilities of the association assembly, and the role of the supervisory authority. Additionally, it includes transitional provisions and annexes defining the associations and their respective areas (Annexes 1 & 2).
