Law implementing the EIA Amendment Directive

Bavaria’s law implementing the EIA Amendment Directive seeks to amend various Bavarian legislative texts to ensure compliance with European Union Directive 2014/52/EU. The Bavarian Administrative Procedure Act (Verwaltungsverfahrensgesetz) is thereby amended to include an article on environmental impact assessments (Art. 78a). The Bavarian Nature Conservation Act (Naturschutzgesetz) is amended by changes in wording of Article 23, par. 6, sentence 1. The law on the responsibilities in state development and in environmental issues (Gesetz über die Zuständigkeiten in der Landesentwicklung und in den Umweltfragen) is amended to clarify the competences of the Bavarian Environmental Ministry. Amendments to several articles in the jurisdiction Regulation (Zuständigkeitsverordnung) are made, which include the addition of provisions on the washing and cleaning agent law (Wasch-und Reinigungsmittelgesetz), on the Environmental damage law (Umweltschadensgesetz), and the Environmental Appeals Act (Umwelt-Rechtsbehelfsgesetz). The cableway regulation (Seilbahnverordnung) and IPPC Sewage Regulation (IVU-Abwasser Verordnung) are amended by changes in wording of arts. 78a sentence 1 for the cableway regulation and § 1, 5, and 6 for the IPPC Sewage Regulation respectively.
