Ordinance on exemptions from protection regulations for specially protected animal and plant species (ArtSchAusnV BE).

The Ordinance provides for a permission to render or remove breeding or resting places of birds or bats located on construction sites and buildings, to the extent necessary for the implementation of permissible construction measures. The Ordinance mandate that, during or immediately after construction, suitable ecological compensation such as replacement nesting sites or habitats must be installed for any breeding or resting places of birds or bats that have been removed. The implementation of ecological compensation must be documented by a competent person and reported to the relevant authority within three months of construction completion.
