Abstract
This Regulation implements provisions of the provisions of the third Chapter of the Federal Nature Conservation Act (amended last 4 March 2020) insofar as the obligations of that Chapter fall within the competence of federal authorities. The Regulation specifies in particular obligations in the sphere of: 1. prevention of harm to nature and landscape according to § 15 paragraph 1 sentence 1 of the Act; 2. the content, type and scope of compensatory and replacement measures in accordance with § 15 paragraph 2 of the Act; and 3. the amount of the compensation payment according to § 15 paragraph 6 of the Federal Nature Conservation Act and the procedure for collecting it. Compensation for harm to nature can also be based on the Water Resources Management Act. The Regulation formulates a general duty to cause harm to nature and requires reasonable alternatives to be used when possible so as to avoid harm to nature.
