Abstract
The Act sets regulations on the management of fisheries with the purposes of protection of living resources in marine- and fresh-water and for the protection of other marine animals and plants, to safeguard commercial fishing and related commercial activities. The Act also applies to fish farming and sale of fish and related activities. The EU Fisheries Committee engages in suggestions to the Minister for Food, Agriculture and Fishery in regards to adherence to the EU regulations of fishery.
Companies or/and individuals eligible to be registered with A-status in commercial fishery, must be of Danish citizenship, engage in fishery activities the past 12 months and have a minimum of 60% of source income from fishery activities. Anyone can practice angling fishing with rod, jig or similar light hand tools. The Minister for Food, Agriculture and Fishery may decide on the application, design, mesh size, location and number of permitted fishing gear and method. Commercial marine-fishing is regulated by the same Ministry who establishes quotas, total allowable catch and by-catch regulations thereof. Fishing Licences are required for these activities and are issued by the same authority. Fresh-water fishing are regulated by the Minister's requirement of fishing areas, periods and water passage requirements (dam, turbines, grids etc.). Safety navigation rules, marking, storage etc. are also regulated in this Act. A production Fee Fund shall be established and approved by the Ministry; the purpose of such fund is to administer any financial transaction related to fishing activities. regulations for the continuing research in fishery is also established by this Act, and inspection regulations are applied for various fishing-related issues in order to adhere to the Act.
The Act consists of 24 chapters and 1 Annex: Scope of the Act, application and definitions (1); Advisory councils (2); Administration of EU legislation and international treaties regarding fisheries (3); Types of fisheries and fishing eligibility (4); improvement, protection and conservation of fish stock (5); Fishing gear (6); Regulation of commercial fishing in marine waters (7); Rules relative to vessels used in commercial fishing in marine waters (8); Regulation of sport fishing (9); Special rules for freshwater fishing (11); Angle fishing and releasing (12); Mariculture (13); Mutual rules between fishermen (14); Relationship of fisheries to other activities (15); First-hand sale (16); Administration production fees (17); Scientific research and exploration activities (18); Delegation and appeal (19); Submission and treatment of data (20); Financial charges (21); Supervision and control (22); Offences and penalties, appeals and confiscation (23); Entry into force and transitional provisions (24).
