Abstract
The aim of this Act is the protection of the marine environment and marine flora and fauna by preventing and reducing pollution of the (marine) environment from ships, aircraft and floating and fixed platforms by solid, liquid, gaseous or other substances.
The Act shall apply to Danish crafts and platforms operating in or over the Danish territorial waters of the territorial shelf and to foreign crafts operating in and over the EEZ and outside the EEZ as far as this is consistent with international law. The Minister shall prescribe rules for the carrying of oil or gaseous substances by ships and shall prescribe the form of an oil record book or a cargo record book to be carried on board of ships. The Act further: (a) regulates the discharge of sewage and garbage of ships in Danish territorial waters and in the Baltic Sea Area, dumping at sea of substances or materials, incineration at sea and other marine pollution; (b) provides for contingency of pollution by oil and chemicals; (c) requires immediate reporting to the Minister for the Environment of any discharge or dumping incidents in contravention of the Act; (d) provides for enforcement and supervision; (e) provides for right of complaint and appeal against administrative decisions; and (f) prescribes offences and penalties.
It consists of 17 Chapters and 2 Appendixes.
Appendix 1 - Aspects to be assessed for processing an application for a permit for dredging.
Appendix 2 - Substances and materials which may only be present in sludges in significant quantities and concentrations.

Consolidation as notified by LBK No. 925 of 2005. The Act does not apply to Greenland nor the Faroe Islands. It may, however enter into force in these countries by Royal Decree.
