Abstract
This Order establishes rules for price caps and maximum prices for the supply of hot water and steam produced by waste incineration plants for heat production and heat delivery systems. The Danish Energy Regulatory Authority (DERA) shall notify price caps of the average price calculated on the basis of heat prices last reported to DERA after review of cost allocations and other conditions for the transport and delivery of district heating and production. The Order does not include waste incineration plants in accordance to rules approving authorized commercial entities list for recovery or disposal of hazardous waste as principal activity mainly operating the incineration of hazardous waste. For the implementation of incineration of hazardous waste, more than 50% of the weighed received waste shall be of hazardous waste and shall meet the requirements of article 52 (sections 3 and 4) of the EU Parliament and Council Directive 2010/75/EU of 24 November 2010 on industrial emissions (Official Journal: L 334 of 17 December 2010, p 17).

Entry into force notes
Entry into force on 1 January 2013 and applies to heat supply contracts concluded after the Order enters into force. For delivery agreements concluded before the entry into force of this Order, the entry into force shall take effect on 1 January 2016.
