Abstract
This Executive Order sets the rules for fees payable to the Danish Utility Regulator for its authority processing, operation and supervisory tasks under the Act on CO₂ capture activities in the utilities sector. It applies to companies participating in CO₂ capture activities linked to electricity or heat production facilities, where the Danish Utility Regulator supervises them and where their total heat supply in the previous calendar year was at least 100 TJ, adjusted for degree days. Covered companies must pay an annual fee calculated at DKK 16.75 per TJ of heat delivered from the associated heat production facility, based on annual reporting to the Danish Energy Agency’s energy producer survey. The fee is collected once a year, must be paid within 30 days of invoicing, and late payment accrues interest. The Order also provides for later adjustment of payments to balance over- or under-recovery of the regulator’s costs over time.
