Abstract
This Order sets regulations with regard to the marketing, production to marketing, import and export of forest reproductive material of tree species (listed in Appendix 3). The Danish AgriFish Agency shall regulate and authorize the vegetation, seed orchard or clone propagating with tree species listed in Appendix 3 as the base material for the production and certification of forest reproductive material. Imports from third countries of propagating material of the species listed in Appendix 3A is not permitted, with the exception of propagating material as specified in Appendix 9. Seeds or cones for propagation purposes of the genus Pinus L. and the species Pseudotsuga menziesii which either originate in the EU or is imported into the EU may only be transported within the European Community if accompanied by certification, or if grown in a country where cases of Gibberella circinata (Fusarium circinatum) do not occur, in accordance with relevant International Standards for Phytosanitary Measures; or is originated in production areas where there have not been detected signs of Gibberella circinata following official inspection, and that have been tested immediately prior to transport and found free of the organism. Small amounts of seeds and cones for non-commercial purposes are exempt from the requirement to plant if there is no risk of spreading the Gibberella circinata organism.

Seed of species listed in Annex 3B, and grown in and imported to Denmark from countries that have not implemented the OECD rules for these species can be certified under the provisions of Executive Order No. 250 on Forest Seeds and Plants of 19 March 2010 if imports are made by 1 July 2014.Propagating material that is generated by the material referred to in Article 23, section 1 may be marketed under the provisions of Executive Order No. 250 on Forest Seeds and Plants of19 March 2010.
