Abstract
This Order regulates the handling and allocation of CO₂ allowances connected to heat production, including free allowances granted to heat production units and their transfer to heat customers or, in certain cases, CO₂ capture undertakings. It defines key terms such as the CO₂ allowance registry, free allocated allowances, return obligations, state-supported CO₂ capture, heat customers and heat production units, and sets rules for calculating CO₂ emissions from heat production, including reductions where CO₂ is captured and stored. The Order establishes procedures for transferring surplus free allowances, returning allowances where needed to meet compliance obligations, allocating allowances among multiple heat customers, setting deadlines for transfers, and determining the value of CO₂ allowances by reference to the average price of CBAM certificates. It also requires heat production units to inform heat customers about relevant emissions and allowance allocations, and provides that certain agreements must be notified to the Danish Utility Regulator.
