Abstract
Terms used in these Regulations and not defined here have the meaning as assigned to them in section 2 of the Pesticides Control Act, 1974, except that pest shall not include endoparasites of animals (reg. 2).
The 15 regulations are divided into 5 Parts: Preliminary (I); Registration of pesticides (II); Licensing of pesticides (III); Decisions of the Board (IV); Miscellaneous (V).
No person shall manufacture, import, advertise, use, sell, expose, or offer for sale any pesticide other than a pesticide that has been registered as an approved pesticide by the Board and published as such in the Gazette (reg. 3, comma 1). Applications for registration with the Board shall be in the form as set out in the Schedule and provide the information and documents specified in commas 3 and 4 of Regulation 3. The requirements of commas 3 and 4 may be dispensed with by the Board if the pesticide for which an application for registration is made, has been previously approved in a Member State of the Caribbean Community (reg. 3, comma 5). No person may manufacture, import, sell, expose or offer for sale any registered pesticide without a licence. The licence may specify restrictions imposed on the activities approved in the licence (reg. 7, comma 3). The licence shall be in the form as set out in the Schedule. The remaining regulations outline procedures of decision-making of the Board, prohibit supply of inferior products and false advertisement, and contain provisions with respect to the transportation of pesticides.
(Schedule: forms of application for registration, approval of registration, application for a licence, and a licence)
