Abstract
These Regulations, comprising 56 articles divided into six Chapters, address a range of topics including general provisions, the national integrated waste management strategy, the duties and responsibilities of involved entities, the prerequisites for conducting integrated waste management operations, and the classification of waste types such as non-hazardous, municipal, construction, agricultural, industrial, and hazardous waste. Additionally, they incorporate provisional measures and provide template forms for license applications, waste registers, and guidelines within the 15 attached Schedules. Chapter three outlines a key policy mandating that waste generators or owners must ensure the secure disposal of waste from their facilities, projects, or operations upon the delivery, initiation, or conclusion of any new, refurbished, or existing projects. This disposal should be completed within a maximum period of twenty days following the project's delivery, start, or the end of the activities that produced the waste, particularly when the waste is located beyond the premises of the specified facilities or projects. Furthermore, these individuals or entities are obligated to comply with the guidelines and stipulations detailed in the appendices accompanying these regulations. The Regulations provide for a grace period of one year for relevant entities to comply with their provisions.
Administrative authorities overseeing non-hazardous waste management play a pivotal role by providing technical and supervisory support, allocating land, and managing tendering processes. These responsibilities apply to both public and private entities. The Waste Management Regulatory Authority (WMRA) oversees integrated waste management, monitors execution plans, assesses waste management units, innovates management methods, and attracts investments. Collaboration involves government bodies, local governments, the private sector, non-profits, and international partners. The Authority establishes an Appeal Committee for grievances (art.20).
In Chapter three's general policy framework, single-use plastic bag rules state adherence to technical specifications by the Egyptian Organization for Standardization and Quality. Retailers must encourage reusable bags and implement a system for collecting single-use plastic bags. Chapter four emphasizes obtaining a license for non-hazardous waste management, requiring either direct WMRA approval or endorsement for Industrial Development Authority-licensed facilities. The chapter covers waste collection, transportation, municipal and agricultural waste treatment, landfill operation, and management of municipal, construction, and industrial waste. In Chapter five, focusing on hazardous waste, the Technical Committee holds the crucial role of formulating, issuing, and reviewing comprehensive lists of hazardous materials and wastes. This involves (i) establishing controls and requirements for proper handling and integrated management, including methods to reduce generation; (ii) designating the ministry or relevant entity responsible for issuing licenses for the circulation and integrated management of hazardous materials and waste; (iii) managing the registration of companies involved in integrated hazardous waste management. Furthermore, the committee exercises authority in addressing hazardous waste and waste under specific conditions, determining responsibilities of ministries and relevant authorities, setting threshold limits, establishing classification standards for generators (both large and small), defining maximum storage durations, and specifying licensing requirements for handling activities related to hazardous waste or waste with conditions.
