Abstract
This Penal Code consisting of 396 articles aims at (i) ensuring order, peace and the security of the State and its inhabitants; (ii) preventing offences by giving due notice of the offences and respective penalties prescribed by law and should this be ineffective by providing for the just treatment and punishment of offenders; (iii) providing an effective, fair and reasonably uniform sentencing system by providing punishment proportional to the severity of offences. It is composed by II Parts: Part I, General, that includes II Books regarding Offences and the Offender (Book I) and Punishment (Book II); and Part II with the Special Part in V Books, namely Offences against (I) International Law; (II) Interests of the State; (III) the Person, Public Decency, and the Family; (IV) Property; (V) Offences involving Drugs.
Within the Offences against the Interests of the State are included the crimes against Public Health and they, among others, regard (i) contamination or distribution of contaminated drinking water, food, medicine or consumable goods, either designated to humans or animals; (ii) contamination of land or fields so as to endanger the life or health of people, animals or plants; (iii) adulteration of goods, foodstuff, medicines or medicinal products; (iv) adulteration of any feed or natural fodder or feeding stuffs, intended for animals, in a manner to endanger the animals' health or life; (vi) spreading of communicable diseases, included domestic or other useful animal and wild animals, or plant diseases; (vii) contribution to shortages or famine through hiding, hoarding, destroying or preventing the transport or distribution of grain, foodstuffs, medicine or provisions necessary to the life or health of human beings, animals or plants.
Book IV in Part II regarding the private property, in this contest deals also with the offence of disturbing another's holding by (i) drawing off public or private waters; (ii) displacing or removing boundary marks.

Entry into force notes
This Code shall come into force on the date of its publication in the Gazette of Eritrean Laws and, except as provided in Article 4, applies only to offences committed wholly or partly after that date.
Notes
The Transitional Penal Code of Eritrea is hereby repealed.
