Abstract
This Proclamation shall apply to any rural land in Ethiopia and certain rural kebeles in the Regions and City Administrations in urban areas. Under Rural Land Administration (Part 1) A person may have the right to freely access rural land where he has been engaged or prefer to engage in agricultural activities for a living; regional laws may create affirmative action rules for women and youths as well as persons with disabilities. Non-Governmental organizations and social institutions may have the right to access rural land as per regional laws he landholding rights of farmers, semipastoralists, pastoralists and Religious Institutions have no time limit. The duration of land use rights of other users shall be determined by regional laws. Rural land holding types include private, communal, and state holdings. The right that farmers, pastoralists, semipastoralists, and Religious Institutions have over their land is a holding right. 2/ Holding right includes the rights of use; lease; sharecrop; collateralize the use right; jointly develop the land with investors; bequeath; donate; transfer through sale or in any form properties fixed on the holding; consolidate; exchange with similar rural land holding, and cultivate the land through cluster arrangement. A rural landholder may lease out part or all of his land holding for a specific period of time that shall be determined by regional laws; other provisions regulates donation, transfer, inheritance, sharecropping, sale, consolidation, clustering of holding. Holders of lands are entitled to registration and where a person has two or more wives the landholding shall be registered in a manner that protects the rights of all the wives in the polygamous marriage. Other provisions concern distribution and re-distribution.
The Federal Government shall prepare a national master land use plan based on the suitability of the land and which ensures sustainable land utilization. Section seven regulates dispute resolution. Part 3 regulates institutions and Part 4 miscellaneous provisions, such as criminal liability.
