Abstract
This Proclamation regulates the use of water resources, by requiring a government permit in respect of most water uses, with the exception of minor and traditional uses (art. 3). The Proclamation further lays down basic criteria for the permit-granting authorities to use in deciding on applications for permits (art. 5). Permits are subject to a term of duration, renewable on expiration (art. 6), and can be varied, suspended, revoked, and transferred, under the circumstances indicated by the statute (arts. 7 and 8). In particular, the Government has authority to vary a permit, subject to compensating the affected permit holder (art. 7.3). Payment of water permit fees and water charges, and the recording of permits in water registers, are also provided for (arts. 10 and 11.4, respectively). The permit granting Government authority also serves as judge of first instance in disputes between permit holders or between a permit holder and another party, concerning rights and obligations under a water utilization permit (art. 13).
