Abstract
According to article 3(1)(a) of Regulation (EU) No. 528/2012, only products that are intended to destroy, deter, render harmless, prevent the action of, or otherwise exert a controlling effect on any harmful organism by any means other than mere physical or mechanical action constitute a biocidal product. Pursuant to this definition of biocidal product, the present Decision stipulates that bacterial cultures that are intended to reduce organic solids, are to be placed on the market for that purpose and have only as a side effect that they reduce the development of algae in water bodies and are not intended for that purpose, are not biocidal products.
