Abstract
In accordance with article 19 of Council Regulation (EC) No. 2100/94, the term of the Community plant variety right shall run until the end of the 25th calendar year following the year of grant. Nevertheless, on the basis of paragraph 2 of the same article, the Council is empowered to provide for an extension of these terms up to a further five years in respect of specific genera or species. Therefore, and in the light of the fact that technical difficulties in potato breeding require expenditure of research activities for a long period in comparison with the overwhelming majority of all the other agricultural crops, the duration of the Community plant variety right in respect of varieties of potatoes is hereby extended by a further five years.
