Abstract
This Regulation makes amendments in certain provisions of Regulations (EU) 2021/2115 and (EU) 2021/2116 and in Annex III to Regulation (EU) 2021/2115 to ensure that Member States can better adapt their CAP Strategic Plans to farmers needs and provide farmers with more flexibility to carry out their agricultural activities taking into account the increasing challenges, extreme meteorological events, including droughts and flooding, and economic uncertainties.
This Regulation allows Member States to establish specific exemptions from the requirements of GAEC standards 5, 6, 7 and 9 in order to address specific problems in the application of those GAEC standards based on objective and non-discriminatory criteria, such as soil types, crops or farming systems or damage to permanent grasslands due, inter alia, to wild animals or invasive species. It underlines that the scope of those exemptions should be restricted, ensuring they do not hinder the standards overall impact in achieving their main objectives, as outlined in Annex III to Regulation (EU) 2021/2115.
This Regulation adjusts the conditionality system established by Regulation (EU) 2021/2115 by removing the obligation to devote a share of arable land to non-productive areas and features from GAEC standard 8 as listed in Annex III to that Regulation.
Furthermore, this Regulation exempts small farmers from conditionality controls pursuant to Regulation (EU) 2021/2116 as well as from the application of administrative penalties for non-compliance with conditionality requirements.

Entry into force notes
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union. Article 2, points (2) and (3), and the Annex shall apply as from claim year 2024.
