Abstract
The present Act establishes a fund to finance the remediation of environmental damage. The purpose of the fund is to ensure that there are financial resources available to clean up pollution and restore damaged ecosystems. The Fund may be used to cover the costs of investigating and assessing environmental damage, remediating environmental damage, and preventing environmental damage. The Fund is financed by charges on certain activities that pose a risk of environmental damage, and fines imposed for environmental offences. Compensation from the Fund is paid for damage if: 1. Compensation cannot be recovered in full from the person who is liable to pay compensation; and 2) It cannot be determined who is liable for compensation under any other law or who is liable for the costs of combating and restoring the damage.
The Act consists of 40 Articles organized in the following chapters: 1. General provisions; 2. Environmental damage charge; 3. Compensation and support; 4. Administration and finances of the Environmental Damage Fund; 5. Party appeals; 6. Special provisions; and 7. Entry into force.
