Abstract
The present Act lays down rules on early retirement from agriculture. When the retirement occurs between 1995 and 1999, it shall be based on the community co-financed system specified in Council Regulation (EEC) No 2079/1992. When the retirement occurs between 2000 and 2006, it shall be based on a national system whose principles correspond to the system for early retirement from agriculture referred to in Council Regulation (EC) No 1257/1999. Retirement support is granted to those who permanently cease agricultural activities and are: 1. Agricultural entrepreneurs who own a farming unit or part thereof; 2. Spouses of agricultural entrepreneurs referred to in point 1, even if they do not have ownership of the farming unit; and 3. Surviving spouses of agricultural entrepreneurs referred to in point 1, if the farming unit subject to the retirement belongs to property in which the surviving spouse has marital rights. Other more specific requisites are also established. The amount of the retirement support is based on the earned income determined for the agricultural entrepreneur under the Act on Pension for Agricultural Entrepreneurs.
