Abstract
The present Government Decree contains provisions on the allocation of funds for nuclear waste management costs. It contains detailed rules on the calculation of the liability amount for nuclear waste management obligors and on the determination of the funding target, which according to the Nuclear Energy Act shall be, for each calendar year, equal to the liability of the previous calendar year. In particular, the Decree complements and regulates the Section 40, Paragraph 2 of the Nuclear Energy Act, as regards cases when the nature of operations of a nuclear facility is such that a considerable proportion of its nuclear waste management costs is made up of costs that do not depend on the amount of nuclear waste. In these cases, according to the Nuclear Energy Act, the Fund target of the nuclear facility in its various years of operation shall be the specified share of the assessed liability of the nuclear facility falling upon the party with a waste management obligation. This procedure is referred to in this Decree as periodization and shall be 40 years. The funding target for each calendar year shall be obtained by multiplying the liability amount for the previous calendar year by the number of years that have elapsed since the beginning of the periodization period, and then dividing the result by the periodization period. Periodization begins on January 1 of the year when nuclear waste first arises or can arise in connection with the commissioning of a nuclear facility. Periodization is not performed after the funding target has reached the liability amount for the previous calendar year.
