In the present case the High Court adopted the reasoning from an Australian case where the court stated that fines against individuals such as the master or captain of the vessel may not deter illegal fishing in that the real offender is usually the foreign owner. That being the case, forfeiture is the only effective way to penalize a foreign owner who is unlikely to have funds in the country with which to pay fines.
