Abstract
This Act is divided into four parts where Part 1 outlines the Short title and Interpretation of the Act. Part 2, establishes the Climate Relocation of Communities Trust Fund, its purpose and application. Part 3, the Management and financial provisions where the accounts must be audited annually by an independent auditor and the preparation of an annual report. The income of the Trust Find is exempted from income tax. Lastly, Part 4, section 10 to 12 stipulates if the fund is dissolved the surplus of the Fund must be utilized for climate change programs, projects, activities in Fiji. Section 11 states that the Minister has the power to make regulation while section 12 contains a consequential amendment whereby the Environment and Climate Adaptation Levy Act 2012 is amended by substituting section 12(3) where the Fiji Revenue and Custom Services must pay money from the Levy to the Climate Relocation of Communities Trust Fund as stipulated under section 3 of the Act.
