A new Part (VIIIa) is inserted in the principal Act. This Part makes provision with respect to the discharge or spillage of petroleum products in the sea.
A new Part (VIIIa) is inserted in the principal Act. This Part makes provision with respect to the discharge or spillage of petroleum products in the sea. Section 38A defines the offence of discharging or spilling petroleum products into the sea or inland waters either from a vessel or a land-based installation. Section 38B lists special defences for persons charged with an offence as defined by section 38A. Section 38C prescribes safety measured that shall be carried out on board of vessels in connection with petroleum products. Section 38D prescribes penalties and provides for jurisdiction and court proceedings. Section 38E defines, amongst others, “petroleum products”. The Director of Marine may, the event of spillage of petroleum, take all such actions and steps as considered necessary to clears such spillage or to prevent spreading of petroleum into the sea.
