Abstract
This Act makes amendments in the principal Act by deleting subsections (1A) and (3) of Section 12 and by inserting Section 12A. This new section lays down transitional provisions. According to these transitional arrangements, any application received for any mortgage registered under section 12 on or after 1 August 2021 and before the commencement of this Act is deemed to have acquired the required consent of the Native Land Trust Board. However, the applications received for any mortgage on or after 1 August 2021 and before the commencement of this Act and under process must acquire the required consent of the Board. Additionally, any charge, pledge, caveat or lease to be dealt with by any court of law or under the process of any court of law on or after 1 August 2021 and before the commencement of this Act is exempted from the consent of the Native Land Trust Board required in Section 12.
