Abstract
This Act establishes the Environmental Protection Agency, defines powers and duties of the Agency, provides for its internal organization, declares the policy Government of Pohnpei in respect of environmental protection and sustainable development, defines responsibilities of the State regarding the protection of the environment and plant and animal life, provides for judicial review of decisions of the Agency, defines offences and prescribes penalties for such offences.
The Agency shall have the power and duty to protect the environment and human health, welfare and safety and shall abate, control, and prohibit pollution or contamination of air, land, and water in accordance with this Act and with Regulations made under it. The Agency shall have also regulation-making powers with respect to a variety of issues including: (a) earthmoving; (b) mining and dredging; (c) environmental impact assessment; (d) water supply systems; (e) pesticides; (f) sewage; (g) solid waste; (h) marine and fresh water quality; (i) air pollution; and (j) groundwater.
