Abstract
This Act makes provision for a wide variety of matters relative to the management and conservation of marine resources, and in particular fish resources in state waters of Pohnpei, i.e. the internal waters of Pohnpei or waters within the state of Pohnpei’s 12 mile zone as defined by this Act.
The Act defines sovereign rights of the Government for the purpose of exploring, exploiting, conserving, and managing fish but also its jurisdiction with regard to: the establishment and use of artificial islands, installations and structures; marine scientific research; and the protection and preservation of the marine environment.
As for fishing, the Act, among other things: (a) requires traditionally recognized subsistence fishing rights in submerged reef areas to be preserved and respected; (b) prohibits driftnet fishing in state waters and places restrictions on commercial fishing; (c) regulates fishing for non-commercial purposes and scientific or experimental research on marine life; (d) prohibits foreign fishing for shellfish, reef fish, specified pelagic fish, marine mammals or any other type of marine life; (e) grants powers to specified authorities to determine the total allowable harvest or catch level of subsistence and recreational fishing for specific species; (f) regulates procedures for obtaining a fishing permit; (g) grants regulation-making powers to the Office of Economic Affairs; (h) prohibits various acts in relation with commercial and non-commercial fishing; and (i) provides with respect to enforcement and establishes the Fisheries Enforcement and Development Fund.
